Frequently Asked Questions About AML/CTF for Fintech & Financial Services Participants

Anti-Money Laundering (AML) in Financial Services refers to a set of laws, regulations, and procedures designed to prevent criminals from disguising illegally obtained funds as legitimate. Financial services firms are required to implement AML programs to combat money laundering and terrorist financing.

The Australian Transaction Reports and Analysis Centre (AUSTRAC) is Australia’s primary financial regulator, responsible for overseeing AML/CFT compliance and ensuring financial institutions report suspicious transactions.

At a minimum, an effective AML program must include: designating a Compliance Officer, developing internal AML policies and procedures, deploying a risk assessment, educating employees and personnel, and including an independent program review.

Key AML/CTF obligations for Fintechs and Financial Services in Australia include: registering with AUSTRAC, developing an AML program, reporting suspicious activity to AUSTRAC, and keeping AML records for at least seven years.

Developing an AML program for Fintechs involves implementing a risk-based approach that includes policies and procedures for customer due diligence (CDD), enhanced due diligence (EDD), sanctions screening, and politically exposed person (PEP) screening. It also requires appointing an AML Compliance Officer.

Technology solutions that can assist Fintech businesses with AML compliance include: Customer Relationship Management (CRM) systems, Identity Verification (IDV) platforms, AML/CFT Screening tools (for sanctions, PEPs, adverse media), Transaction Monitoring systems, Case Management Systems (CMS), and Social Network Analysis (SNA) tools.

Customer Due Diligence (CDD) is a cornerstone of AML compliance and requires Fintech businesses to identify and verify the identity of their customers and conduct ongoing monitoring for suspicious transactions. Digital identity verification, like biometrics, can play an important role in CDD.

Depending on the circumstances, firms could face penalties from AUSTRAC including: civil penalty orders, enforceable undertakings, infringement notices, remedial directions, and written notices to appoint an external auditor.
